THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36853 OF 2016 ORDER:
The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the fourth respondent in opening and continuing Suspect Sheet No.23 of 1996 against the petitioner as illegal and arbitrary, and consequently, to direct the respondents 3 to 5 to close the Suspect Sheet against the petitioner.
Heard and perused the material.
Learned counsel for the petitioner submits that the petitioner was falsely implicated in six cases in 1996 and that in all the cases, the petitioner was acquitted. He further submits that on the direction of the third respondent, the fourth respondent opened the rowdy sheet and continuing the same. Hence, he prays this Court to direct the respondents 3 to 5 to close the suspect sheet against the petitioner. Considering the facts and circumstances of the case, the petitioner is directed to make a representation to the third respondent stating that he is not involved in any other crimes after 1996 and on filing of such application, the third respondent is directed to consider the representation and pass appropriate orders. Further, the respondents 3 to 5 are directed not to compel the petitioner to attend before the Police Station. The writ petition is accordingly disposed of.
