HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.27091 of 2015 ORDER:

Heard.

The petitioner claimed to be an assignee of the land admeasuring Ac.1-00 cents in Sy.Nos.341-3A2 and 341-3B situated at Kalyanadurgam Village and Mandal, Anantapur District. It is stated that as against some third parties interference, the petitioner filed a suit in O.S.No.58 of 2014 on the file of the Junior Civil Judge, Kalyanadurg, seeking permanent injunction and the said court, after verifying the records, granted status-quo on 28-05-2015 in I.A.No.179 of 2015. The petitioner, however, states that respondents 3 and 4 are taking steps to dispossess him without initiating any enquiry and without issuing any notice.

Learned Government Pleader has received instructions from the 4th respondent, which state that the assignment as claimed by the petitioner could not be traced out in the official records. However, in view of the fact that a case is pending before the 3rd respondent, at present no action is initiated by the 4th respondent to dispossess the petitioner in the above said survey numbers.

The said categorical statement on behalf of the 4th respondent clearly shows that there is no attempt to dispossess the petitioner as alleged by him. Hence, no further orders are required to be passed in the present writ petition. Accordingly, the writ petition is disposed of. No costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
