The petitioner is doing rice business under the name and style of M/s. Raja Rajeswari Industries situated at Samshabad Mandal, Hyderabad. While so, on 07.07.2015 the third respondent-Assistant

Supply Officer, Chevella Division inspected at Siddeswara Poultry Farm and found 50 quintals of rice meant for Public Distribution System and conducted panchanama. Alleging that the petitioner purchased PDS rice from the cardholders and kept at Siddeswara Poultry Farm, the third respondent seized the said 50 quintals of rice. Proceedings under Section 6-A of Essential Commodities Act were initiated against the petitioner. Based on the report of third respondent, a show cause notice was issued to the petitioner on 25.07.2015 by the second respondentJoint Collector. The petitioner submitted his explanation on 06.08.2015. Since the respondents are trying to dispose of the seized stock in the open market and not releasing the same to the petitioner, the present writ petition is filed.

In the show cause notice, the value of the seized stock is shown as Rs.65,000/-. The petitioner voluntarily agreed to pay the said amount through bank guarantee for release of the seized stock. In the circumstances, the second respondent is directed to release the seized stock of the petitioner on furnishing bank guarantee for a sum of Rs.65,000/- within two weeks from the date of receipt of a copy of this order.

With the above directions, the writ petition is disposed of. There shall be no order as to costs. Miscellaneous Petitions, if any pending in this writ petition, shall stand closed.
