WRIT PETITION NO. 23494 OF 2014 O R D E R :
Heard Sri Ch. Venkata Narayana for petitioner and the Assistant Government Pleader for respondents.
2. The petitioner prays for mandamus declaring the action of second respondent in taking steps to fill up Fair Price Shop No.223, Chinagadili, Santhapalem, Visakhapatnam district on permanent basis as illegal, arbitrary and contrary to G.O.Ms.No.4, Consumer Affairs, Food and Civil Supplies [CS-I] Department, dated 28/2/2014.
3. The petitioner claims to be an un-employee and son of deceased Fair Price Shop Dealer. The petitioner makes claim for consideration of his case under G.O.Ms.No.4, Consumer Affairs, Food and Civil Supplies [CS-I] Department, dated 28/2/2014. The oral request of learned counsel for the petitioner to implead the Revenue Divisional Officer, Visakhapatnam is accepted and the Revenue Divisional Officer, Visakhapatnam is added as third respondent to this writ petition.
4. The Assistant Government Pleader having regard to the
scope of G.O.Ms.No.4, dated 28/2/2014 submits that the third respondent/Revenue Divisional Officer, Visakhapatnam may be directed to consider the claim of the petitioner in the light of G.O.Ms.No.4, dated 28/2/2014 and appropriate orders be passed.
5. I am satisfied that the writ petition can be disposed of by this order.
6. The petitioner is given liberty to make representation along with a copy of this order within six weeks from the date of receipt of a copy of this order to the Revenue Divisional Officer, Visakhapatnam/third respondent herein to consider her case for appointment as Fair Price Shop Dealer on compassionate grounds under G.O.Ms.No.4, dated 28/2/2014 and the Revenue Divisional Officer, Visakhapatnam, is directed to consider the application and pass orders within six weeks from the date of receipt of such representation.
7. The writ petition is disposed of. No costs.
8. As a sequel, miscellaneous petitions if any, pending in this Writ Petition shall stand closed.
