HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION NO. 1360 OF 2017 ORDER:

This Writ Petition was filed challenging the action of the 4th respondent in not registering crime pursuant to the complaint made by the petitioner on 5.12.2016.

The 4th respondent filed a counter affidavit stating that the petitioner submitted a complaint on 5.12.2016 and the same was entered into the Station General Diary and preliminary enquiry was made and in the preliminary enquiry it came out that the dispute is purely civil in nature and accordingly, the petitioner was advised to appear before the competent Civil Court seeking redressal of his grievance. According to him, it is the dispute between the petitioner, who is tenant and the 5th respondent, who is lessor regarding the ownership and in those circumstances, he has not taken any action against the complaint filed on 5.12.2016.

In view of the above facts, it is open to the petitioner to take appropriate legal proceedings in accordance with law and this Court cannot give direction in the present Writ Petition.

Accordingly, the Writ Petition is closed. There shall be no order as to costs. As sequel thereto, Miscellaneous Petitions, pending if any, shall stand closed.
