HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.8767 OF 2010 ORDER:

The writ petition is filed questioning the action of the respondents 2 and 3 in permitting the respondents 4 to 40 and others similarly situated licensees in conducting (transacting) business (vegetable vending) within the market yard, contrary to the conditions of licenses given to them.

Heard both sides.

In the counter-affidavit filed by the 2nd respondent, it has been stated that the 2nd respondent had constructed the separate sheds within the premises of the L.B. Nagar Vegetable Market Yard and allotted the space to all the valid license holders including the respondents 4 to 40. In that view of the matter, the relief claimed in the present writ petition had become infructuous. However, if the petitioners are aggrieved with the licenses granted in favour of the respondents 4 to 40, it is always open for them to ventilate their grievance, in accordance with law, for which there is no requirement of this Court's permission as is being sought by the petitioners' counsel.

With the above observations, the writ petition is dismissed as infructuous. No order as to costs.

Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
