HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.No.35641 of 2016 ORDER:

Heard the learned counsel for the petitioner and Sri P.Durga Prasad, learned Standing Counsel for the respondents. Petitioner has assailed the order dt15-10-2016 placing the petitioner under suspension.

It is not the case of the petitioner that the order of suspension imposed on the petitioner is without jurisdiction or malafide. Learned counsel for the petitioner sought to contend that there is no cause to place the petitioner under suspension pending enquiry since the petitioner is not guilty of the allegations made against him. Admittedly charge has been framed against the petitioner on 15-10-2016 and the impugned order has been passed keeping him under suspension pending enquiry into the said charge. Therefore, the innocence or guilt of the petitioner has to be established in the enquiry to be conducted pursuant to the charge memo issued to the petitioner. Therefore, I do not find any merit in the Writ Petition and the same is accordingly dismissed. No costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
