ORDER:

This Writ Petition is filed for a Mandamus to declare the action of the respondents in seizing 143 bags of paddy each containing 74 kgs along with lorry bearing registration No.AP 04 U 2995 as illegal and arbitrary. A perusal of the record shows that the abovementioned stock along with the lorry was seized under a panchanama, dated 12.02.2009, wherein it is stated that proceedings under Section 6-A of the Essential Commodities Act, 1955 (for short 'the Act') are proposed to be initiated.

Though the Writ Petition has been pending for six years, no counter-affidavit is filed and no information as to the initiation of proceedings under Section 6-A of the Act and whether such proceedings, if initiated, were concluded or not is forthcoming. However, as the

respondents have to take the seizure to its logical end, it is reasonable to presume that such proceedings were initiated and completed in view of long lapse of time. On this premise, the Writ Petition is disposed of as infructuous.
