HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition Nos.28569, 28578, 28611 and 28616 of 2009 COMMON ORDER:

In these four Writ Petitions the validity of the proceedings of the Nagarjuna University, in demanding university development fee of Rs.1,00,000/-, Rs.1,50,000/-, Rs.1,50,000/- and Rs.1,50,000/- respectively, is questioned, as being arbitrary and illegal. This issue fell for consideration in W.P.No.27195 of 2007 and batch, and a Learned Single Judge of this Court, by a common order dated 08.02.2010, allowed the Writ Petitions and set aside the demand notice issued to the petitioners on the ground that they were not based on any statute, ordinance or regulation, made under the A.P. Universities Act, 1991.

It was, however, left open to the University to inquire whether the petitioners had collected any amount from the students towards development fee/infrastructure fee, and if it emerged that the fee has been collected, the petitioners were under obligation to refund the same to the students, or pay it to the University. The Learned Single Judge further observed that, if any statement made by the petitioners in this regard was found to be incorrect, that would, by itself, be a ground to deny renewal of affiliation.

Following the common order in W.P.No.27195 of 2007 and batch dated 08.02.2010, and in terms thereof, these Writ Petitions are also disposed of. The miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs. _________________________________ RAMESH RANGANATHAN, ACJ.
