THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13680 of 2025 ORDER:

Seeking the Court to enlarge the petitioner-accused No.7 in Crime No.1152 of 2025 of Medipally Police Station, Rachakonda Commissionerate, on bail, the present petition is filed. 2 .

The brief facts of the case are that, on 22.09.2025, the defacto complainant lodged a report stating that the deceased was his son, a second-year B.Tech student at Siddhartha Engineering College, residing in the boys' hostel. According to the complaint, the deceased committed suicide due to harassment by the accused. It was alleged that accused Nos.1 to 4 physically assaulted the deceased, prompting him to send a selfie video to his father, stating that he was going to end his life because of the harassment inflicted by the accused. Based on the complaint, a case was registered as Crime No.1152 of 2025 for offences punishable under Sections 118(1), 308(2), 108, 191(2) read with 190 of the Bharatiya Nyaya Sanhita (BNS) and Section 3(2)(v) of SCs and STs (POA) Act, 2015.

Heard Sri Mogili Anaveni, learned counsel appearing for the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent-State. 4.

Learned counsel for the petitioner submitted that the petitioner is innocent of the allegations leveled against him and the petitioner is the hostel owner, in fact, the petitioner had gone to the scene of the offence to protect the deceased, attempted to pacify the quarrelling students, and mediated to resolve the issue and that the petitioner had even provided money to the deceased to settle the bar bill, and that no specific allegations have been made against him. He further submitted that the petitioner was arrested on 23.09.2025 and has been in judicial custody since then. Moreover, the prime accused, Accused No.2, has already been granted bail by the trial Court, and a substantial portion of the investigation has been completed. Therefore, prayed the Court to grant bail to the petitioner by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the allegations against the petitioner are severe in nature and that the investigation is still ongoing and are yet to receive the post mortem report of the deceased, releasing the petitioner on bail at this stage may lead to tampering with

evidence or intimidation of witnesses and prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon a perusal of the material available on record, it is evident that the petitioner has been in judicial custody since 23.09.2025. As reflected in the remand case diary, prosecution witnesses LWs.1 to 18 have already been examined and accused No.2 already been granted bail by the trial Court. Considering the overall facts and circumstances of the case, including the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions:

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned Principal Junior Civil Judge-cum-IV Additional Judicial Magistrate of First Class, MedchalMalkajgiri at L.B. Nagar.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier,

for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.

(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
