HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.1849 of 2017 ORDER:

This writ petition is filed with the following prayer: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents-police in not taking action on the complaint given by the petitioner on 07.01.2017 as illegal, arbitrary and contrary to the provisions of Cr.P.C., and consequently direct the respondents-police to take necessary action on the complaint given by the petitioner on 07.01.2017 against the 4th respondent and his followers in accordance with law and to pass such other order or orders as this Hon'ble Court may deem fit, just and proper in the circumstances of the case."

Learned Government Pleader for Home, on the basis of written instructions, submits that no complaint dated 07.01.2017, as alleged by the petitioner, was filed and pursuant to the complaint of the petitioner dated 21.01.2017, a case was registered in Cr.No.25 of 2017 on 21.01.2017, for the offences under Sections 447, 427 and 506 read with Section 34 IPC, investigation is under progress.

In view of the same, no further orders need be passed in this writ petition and the same is accordingly closed.

Pending miscellaneous petitions, if any, shall stand closed. No costs.
