ORAL ORDER:

Heard learned counsel for petitioner and learned standing counsel for respondent municipal corporation and with their consent, the writ petition is taken up for final disposal at the stage of admission. Petitioner alleges that he is owner and in possession of house plot bearing No.10/A admeasuring 336 sq yards in Survey NO. 190, Block No.6, Boudhanagar village, Jeedimetla mandal, Quthbullapur, Ranga Reddy district. Petitioner alleges that though property belongs to him, illegally and without just cause and without following the due process of law, respondent municipal corporation is interfering with the peaceful possession and enjoyment and obstructing the petitioner to enter into the property.

Learned counsel for petitioner tried to assert that property was purchased by the petitioner and he is in possession and enjoyment of the same.

The affidavit filed in support of the writ petition is silent about the instances and details of authorities of the municipal corporation who resorted to such interference and which authority has prevented the petitioner from entering into the property belonging to him. This Court cannot go into the issue of possession and enjoyment and ownership of the property. If the petitioner has any grievance against any officer/employee of the respondent corporation, who is illegally obstructing the petitioner's entry into the subject property or preventing him from peaceful possession and enjoyment, he shall make a complaint to the Assistant Commissioner, GHMC, Circle 15 and on receipt of such a complaint, the Assistant Commissioner, GHMC, Circle 15 shall verify and pass appropriate orders within a period of three weeks from the date of receipt of complaint from the petitioner.

Accordingly, writ petition is disposed of. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed. ______________ P NAVEEN RAO,J DATE: 14.12.2016 TVK
