This petition is filed by the official respondents to review the order dated 29.04.2025 passed by this Court in W.P.No.34235 of 2023.
Learned Assistant Government Pleader for Stamps and Registration submits that while disposing the W.P.No.34235 of 2023 on 29.04.2025, it is stated that this matter is covered by the orders passed by this Court in W.P.No.15471 of 2024 dated 02.07.2024 but failed to notice that the rejection order passed by the respondent No.2 is referred to orders passed in SLP(Civil) No.19695 of 2021 on the file of the Hon'ble Supreme Court. Learned Assistant Government Pleader for Stamps and Registration further submits that the Hon'ble Supreme Court passed interim order dated 18.05.2022 in SLP(Civil) No.19695 of 2021 suspending the operation of the High Court orders in W.P.No.328 of 2022 and batch dated 18.02.2022.
Learned Assistant Government Pleader for Stamps and Registration further submits that the parties in the subject document had earlier filed W.P.No.13256 of 2022 and obtained directions for registration in terms of common orders passed in W.P.No.328 of 2022 and batch dated 18.02.2022 and the same is modified by order dated 22.02.2022 in I.A.No.2 of 2022 in W.P.No.2985 of 2022, thereby, restoring the applicability of C&IG Memo No.G2/257/2019 dated 26.08.2020 and 29.12.2020, which prohibits registration of unauthorized layouts. Initially, the
impugned refusal order dated 22.09.2022 was passed basing on the Memo No.G3/3247/2018 dated 01.05.2019 issued by the Commissioner and Inspector General (R&S) Department. Therefore, on the ground of error apparent on the face of the record, as the applicability of binding instructions/Memos issued by the Commissioner & Inspector General of Registration and Stamps Department, Hyderabad, which have been revived by the Hon'ble Supreme Court, was not considered at the time of passing the impugned order. Hence, requested to review the order dated 29.04.2025 passed by this Court in W.P.No.34235 of 2023 and allow the review petition by setting aside the order dated 29.04.2025 passed by this Court in W.P.No.34235 of 2023.
On the other hand, learned counsel for the writ petitioner not disputed the order dated 18.05.2022 in SLP(Civil) No.19695 of 2021 passed by the Hon'ble Supreme Court, with regard to stay of operation of the order dated 23.08.2021 in W.P.No.9248 of 2021 passed by this Court with regard to Memo No.G2/257/2019 dated 26.08.2020. But, learned counsel for the writ petitioner submitted that this Court rightly passed the order dated 29.04.2025 in W.P.No.34235 of 2023 and requested this Court to dismiss the review filed by the official respondents.
Upon hearing both sides and on perusing the entire material on record, this Court is of the considered view that having regard to the submissions made by the learned counsel for the writ petitioner, the W.P.No.34235 of 2023 was disposed of on 29.04.2025 as the covered order dated 02.07.2024 in W.P.No.15471 of 2024 passed by this Court, without taking into account of the order dated 18.05.2022 in SLP(Civil) No.19695 of 2021 passed by the Hon'ble Supreme Court.
In view of the same, the order dated 29.04.2025 passed by this Court in W.P.No.34235 of 2023 is liable to
be set aside and the W.P.No.34235 of 2023 is to be restored for filing counter of the official respondents. Accordingly, this I.A.No.2 of 2025 is allowed by setting aside the order dated 29.04.2025 in W.P.No.34235 of 2023 passed by this Court.
Registry is directed to restore the W.P.No.34235 of 2023 on its file.
