THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos.12544 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.2 to 6 seeking bail in the event of their arrest in connection with Crime No.1093 of 2023 on the file of Neredmet Police Station, Cyberabad, Malkajgiri District, registered for the offences under Sections 498-A of IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

On the basis of the complaint filed by the de-facto complainant, the Police Neredmet registered the case for the above said offences.

Several allegations are made in the complaint regarding harassment by the petitioners herein.

However, learned counsel appearing for the petitioners had produced judgment in C.C.No.1041 of 2017 which was filed

by the de-facto complainant, wherein these petitioners were tried for the said offences and acquitted later by the said Court. 6.

Perusal of the complaint would reveal that allegations made are prior to 2017. Further, there are allegations subsequent to the acquittal in the present case also. The petitioners are residents of Haryana and Delhi. Prima facie, the allegations appear to be improbable in the background of disputes between the parties.

Accordingly, the Criminal Petition is allowed. In the event of arrest of these petitioners, the petitioners shall be released on bail on executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to the satisfaction of Station House Officer, Nerdermet Police Station, Cyberabad, Medchal-Malkajgiri District.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
