This Writ Petition is filed seeking a direction to the respondents to consider the cases of the petitioners for allotment of house sites along with other employees, without disqualifying them on the ground that they were extended house building loan, as per the orders of this Court in W.P.No.19866 of 2008, dated 27.11.2008.

The case of the petitioners is that they are the employees of the first respondent Devasthanam; the first respondent Board framed a scheme known as "own your house" in the year 1983 and the scheme envisages allotment of house sites to all the employees except those who have availed house building loan from the Devasthanam or those who have been allotted plots or flats on earlier occasion; as the petitioners have availed the house building loan, they have been denied the benefit of allotment of plots; the similarly situated persons filed W.P.No.

19866 of 2008 and the said Writ Petition was allowed by this Court directing the respondents to consider the cases of the petitioners for allotment of house sites along with other employees without disqualifying them on the ground that they have granted house building loan; against the said orders, the first respondent Devasthanam Board filed Writ Appeal No.374 of 2009 and the same was dismissed on 25.09.2009. In view of the fact that the similar relief has been granted to the similarly situated persons in W.P.No.19866 of 2008, dated 27.11.2008, and as the same was confirmed by the Division Bench of this Court in Writ Appeal No.374 of 2009, dated 25.09.

disqualifying them on the ground that they have been extended the house building loan. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
