2015-02-04Challa Kodanda Ram2 pages

HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.41352 OF 2014 O R D E R:

The grievance of the petitioner is very limited to the extent of not conducting elections for appointment of the Trustees for the management of Shahi Jamia Mosque situated at Adoni, Kurnool District.

When the matter came up for admission on 20.01.2015, considering the nature of relief, notice was ordered to the 2nd respondent-Wakf Board, and the learned counsel Sri Mohd. Habeebur Rahaman took notice on behalf of the 2nd respondent. Today when the matter is listed, learned counsel appearing for the 2nd respondent submits that the 2nd respondent is in the process of preparing necessary electoral list to conduct the elections for Trust Board. He submits that the entire process would take about eight weeks as the verification with regard to eligible Musallies has to be done, which is a laborious process. However, within eight weeks they will complete the entire process.

The learned counsel for the petitioner accedes to the fair submission made on behalf of the 2nd respondent. Considering the rival submissions and considering the fact that there is a possibility of very unforeseen occurring, I am inclined to direct the 2nd respondent to complete the entire process without fail within three months from today. It is made clear that they shall not seek any enlargement of time, as it is stayed for the last five years and there is no elected body managing the affairs of the

Shahi Jamia Mosque.

Accordingly, the writ petition is disposed of at the admission stage.

There shall be no order as to costs.

Miscellaneous petitions, if any, shall stand closed. ------------------------------------ CHALLA KODANDA RAM, J Dated:04.02.2015.
