THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.21270 OF 2017 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction on the part of the respondent No.2 in considering the representation, dated 09.06.2017 submitted by the petitioner for and extending of the statutory benefit of Rule 39 of the AP Excise (Grant of License to sell Toddy Conditions of License in favour of the petitioner and Tapping of Excise Trees) Rules, 2007 to continue the petitioner with the eligible Tappers/members as arbitrary, illegal, abdication of the statutory duty cast on him and violative of the fundamental rights guaranteed to the petitioner under Article 14 and 21 of Constitution of India and consequently direct the respondent No.2 to 4 to permit the petitioner society to run its business granted through license in Rc.No.A2/581/2012, dated 01.11.2012 under the benefit of Rule 39 of AP Excise (Grant of License to sell Toddy Conditions of License and Tapping of Excise Trees) Rules, 2007."

After arguing for sometime, learned counsel for the petitioner requested the Court to direct respondent No.2 herein to consider the representation, dated 09.06.2017, of the petitioner and pass appropriate orders in accordance with law.

Considering the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, respondent No.2 is hereby directed to consider the
representation, dated 09.06.2017, of the petitioner and pass appropriate orders in accordance with law as expeditiously as possible, preferably, within a period of eight (8) weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
