HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Civil Revision Petition No. 294 of 2016 Order:
This Civil Revision Petition is filed by the tenants against the order, dated 05.10.2015, passed in RA No.183 of 2013 by the learned Additional Chief Judge, City Small Causes Court, Hyderabad, confirming the order passed by the learned I Additional Rent Controller, Hyderabad, in RC No.244 of 2006, dated 16.07.2013.
2. The respondent - landlord filed RC No.244 of 2006 seeking eviction of the tenants and the said Rent Control Case was allowed, by an order dated 16.07.2013. The same was confirmed by the appellate Court in RA No.183 of 2013, by an order dated 05.10.2015. Challenging the same, the above CRP is filed.
3. When the Civil Revision Petition came up for consideration before this Court, it is submitted by both the counsel that both the parties have entered into a compromise, by virtue of which the petitioners - tenants undertook to vacate the premises by 01.01.2017 and also undertook to pay the monthly rents regularly till such time.
4. Though, they have filed a memorandum of compromise before this Court, in the absence of parties, the same is not recorded, but it is taken as undertaking accepted by both the parties.
5. In view of the above, the findings recorded by both the Courts below are confirmed and the undertaking to vacate the premises on or before 01.01.2017 is recorded.
6. The Civil Revision Petition is, accordingly, disposed of. However, in the circumstances, no costs.
7. As a sequel thereto, the miscellaneous petitions, if any, pending in this Civil Revision Petition shall stand closed.
