HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 33063 of 2011 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties the writ petition is disposed of at the admission stage itself.

The present writ petition is filed seeking a direction to the respondents to dispose of the application made by the petitioner on 03.09.2011 for conducting survey in respect of land admeasuring Ac.6.50 cents situated in Sy.No.2/4 of Ramanujapuram Village, Koilagudem Mandal, West Godavari District.

The averments in the petition would show that the petitioner purchased Ac.14.56 cents of land from Dokala Appana and another for a valid consideration under registered sale deed dated 15.06.1984. It is stated that since then he is in possession of the property. While things stood thus, one Adapa Venkateswara Rao and Adapa Mukkayya, who are the neighbouring land owners, started interfering with the peaceful possession and enjoyment of the land by the petitioner. Hence, he filed O.S.No.25 of 2006 on the file of the I Additional Junior Civil Judge, Kovvur, seeking perpetual injunction restraining them from interfering with his peaceful possession and enjoyment. The said suit was decreed on 04.08.2006. Then, the petitioner made an application dated 03.09.2011 to the respondent for survey of the land and to fix boundaries after paying the necessary fees. It is stated that till

date the said application is not considered. Hence the present writ petition.

No counter is filed and Government Pleader for Revenue submits that there are no instructions as to the present status of the application.

Without going into the merits of the case and since the request is only with regard to considering the representation dated 03.09.2011, the writ petition is disposed of directing respondent Nos.2 and 5 to consider the application made by the petitioner for conducting survey and fixing the boundaries for the land admeasuring Ac.6.50 cents situated in Sy.No.2/4 of Ramanujapuram Villagem, Koilagudem Mandal, West Godavari District, if the same is still pending, in accordance with law, within a period of six (06) weeks from the date of receipt of a copy of this order, after giving prior notice to the petitioner. No order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
