HON'BLE SRI JUSTICE P.NAVEEN RAO ORDER:
The petitioner submits that she is the owner of land to an extent of 44.1 square yards of built up area and with an open area admeasuring 44.8 square yards in Survey No.1609-A of Yadiki Village and Mandal, Anantapur District. The petitioner alleges that the third respondent is threatening to evict the petitioner from the said property on the alleged ground that the petitioner is in occupation of land classified as 'poramboke' and does not belong to her.
2. No material is placed on record to show that there is such threat administered on the petitioner and proceedings are issued against the petitioner calling upon her to explain the status of the petitioner as owner of the said property. Thus, as seen from the material on record, it is only an apprehension of the petitioner that coercive action is being taken by the third respondent Gram Panchayat on the allegation of treating the land classified as 'Poramboke'. Thus, the writ petition in the present form, at this stage, is not maintainable and is liable to be dismissed.
3. Accordingly, the Writ Petition is dismissed. However, it is needless to observe that if the Panchayat Secretary, Yadiki Gram Panchayat, Anantapur District (3rd respondent) is of the opinion that the petitioner do not have valid title and that the petitioner has encroached on to the Government land and
illegally constructed, the 3rd respondent shall take appropriate action, as warranted by law, against the petitioner by following the due process after putting the petitioner on notice. There shall be no order as to costs.
