THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 20029 of 2016 ORDER :

This Writ Petition came to be filed with the following prayer:

"...to issue a Writ, Order or direction more particularly one in the name of Writ of Mandamus declaring the highhanded action of the respondent Nos. 2 to 5 in illegally interfering with the petitioner's possession of the petitioner's agricultural land bearing Sy. No.193 admeasuring to an extent of Ac.1.08 gts situated in Erlapally Village, Chevella Taluk, Ranga Reddy District as illegal, arbitrary and to pass..."

2. Heard the learned counsel for the petitioner and the Assistant Government Pleader for Home for the State of Telangana appearing for respondents 1 and 2. Since this Court is not adjudicating the case on merits, it may not be necessary to hear respondents 3 to 5.

3. The case of the petitioner is that respondent No.3 offered to sell his agricultural land admeasuring Ac.0.30 gts in survey No.192 and Ac.1.08 guntas in survey No.193, situated at Erlapally Village, Chevella Taluk, Ranga Reddy District, to him for a total sale consideration of Rs.20,00,000/- and accordingly an agreement was entered into between them on 01.01.2014 and petitioner paid a sum of Rs.3,00,000/- as part of sale consideration. It is his case that on 03.08.2015, he paid a sum of

Rs.7,00,000/- to respondent No.3 as part sale consideration, upon which respondent No.3 handed over physical possession of the property and executed a registered sale deed in his favour in respect of Ac.0.30 guntas in survey No.192. It is his grievance that he approached respondent No.3 for registration of the land, but, with the influence of respondent No.2, Sub Inspector of Police, Chevella along with his henchmen, beat the petitioner, and when the petitioner approached the police station, Sub Inspector of Police, Chevella refused to register a case basing on a report filed by petitioner, and that Sub Inspector of Police, Chevella at the instance of respondent No.3 is trying to settle the civil disputes by threatening the parties.

4. Learned Assistant Government Pleader, on instructions, states that respondent-police are not interfering in civil disputes and they are acting in accordance with law.

5. Recording the said submission, the Writ Petition is disposed of making it clear that any action taken by the police shall be in accordance with law. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs. ______________________ C.PRAVEEN KUMAR, J 22.06.2016
