THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.24817 OF 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India for the following relief:
"to issue a writ, order or direction, more particularly one in nature of Writ of Mandamus declaring the action of the respondents 2 and 3 in not taking appropriate action in pursuant to the petitioner's representations Dt.02.02.2015 and 24.11.2013 for registration of crime and thorough investigation is illegal and arbitrary and consequently direct the respondents 2 and 3 to initiate appropriate action and to pass such other order or orders as this Hon'ble Court may deems fit and just and proper in the circumstances of the case ."

When the matter is called today, written instructions dated 18.09.2015, furnished by the Assistant Sub Inspector of Police, Parigi Police Station, Anantapur District, have been placed on record by the learned Government Pleader for Home and the said instructions read as under:
"It is submitted that the petitioner herein also lodged complaints with this respondent police station stating that on 16.09.2015 the said Thippeswamy and others were mesmerized the wife of the complainant and took away her from the house of the petitioner herein to Bangalore. Thus the complainant/petitioner herein requested the police to take necessary action. It is submitted that the basing on the said complaint a case in Cr.No.97/2015 U/s. 363 r/w.34 IPC has been registered on 16.09.2015 against 1)Tippeswamy 2)Rajanna of Bangalore 3) M.Adilakshmamma of Anantapur and 4) M.Nagendra of Gollapalli Village as accused on the file of Parigi police station, Anantapur District and took up the investigation.
It is submitted that the matter is under investigation. Basing on the merits of the investigation
the case will be finalized in accordance with law and an appropriate report will be filed before the concerned Hon'ble Court as expeditiously as possible. It is further submitted that the petitioner herein failed to make the party respondents to the effected parties in the above writ petition.
It is submitted that the respondents police discharged their legitimate duties and basing on the complaint of the petitioner herein the above FIR was registered and it is under investigation. It is submitted that the all the other allegations made against the official respondents herein are false, baseless and hence the same are hereby denied. Hence the writ petition deserves no consideration and liable to be dismissed.
It is submitted that the respondents police shall obey the directions if any passed by this Hon'ble Court."
3. On noticing the said instructions, learned counsel for the petitioner requested this court to dispose of the writ petition by recording the written instructions.
4. In view of the above, writ petition is disposed of, by recording the written instructions dated 18.09.2015, furnished by the Assistant Sub Inspector of Police, Parigi Police Station, Anantapur District.
