HONOURABLE SRI JUSTICE S.RAVI KUMAR Tr.CMP.No.528 of 2014 O R D E R:

This petition is filed to withdraw H.M.OP.No.9 of 2013 from the file of Senior Civil Judge, Bapatla and transfer the same to Family Court, Visakhapatnam. Wife filed this application and according to her affidavit, her marriage was performed on 28.08.2010 with the respondent at Koppapalem village and after she became pregnant the respondent did not provide any medical facility and did not take care of her and she adjusted with the attitude of the respondent without informing to her parents. Due to harassment after giving birth to male child on 24.09.2011 and also due to the adamant attitude of the parents of the respondent she is living with her parents. Respondent filed H.M.OP.No.

9 of 2013 before Senior Civil Judge, Bapatla, she filed her counter and contesting the same and when she attended Bapatla Court, respondent and his parents threatened her with dire consequences. It is further stated that she is not in a position to maintain her and maintain her male child. For that, she filed FCOP No.907 of 2014 before Additional Family Court, Visakhapatnam seeking maintenance and both the cases have to be tried by one Court. She further stated that her father became old and it is difficult for her to travel from Visakhapatnam to Bapatla for the purpose of defending FC.OP.No.907 of 2014. For these reasons, she prayed for transfer of said O.P. to Visakhapatnam. Respondent inspite of service of notice neither appeared in person nor through any advocate.

Heard advocate for petitioner.

Considering the reasons stated in the affidavit and also considering the convenience of wife, H.M.OP.No.9 of 2013 is withdrawn from Senior Civil

Judge, Bapatla and transferred to Additional Family Court, Visakhapatnam to be tried along with FCOP No.907 of 2014.
