SMT JUSTICE T. RAJANI CRIMINAL PETITION No.12225 of 2011 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C., seeking to quash the proceedings against the petitioners in Crime No.133 of 2011 of Mandapeta Rural Police Station, East Godavari District, registered for the offence punishable under Section 498-A read with 34 IPC.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.

Learned counsel for the petitioners submits that a similar complaint was filed earlier based on the same set of facts and the same was registered as a case in Crime No.115 of 2006 for the offence punishable under Section 498-A read with 34 IPC. He further submits that after filing of this complaint, mutual divorce was obtained and petitioners also filed a copy of the order in O.P.No.122 of 2014 granting divorce to the parties on mutual consent. He further submits that based on the earlier complaint, the case was numbered as C.C.No.63 of 2007 and the petitioners herein were acquitted in the said case.

Considering the above, the proceedings against these petitioners in this case cannot be permitted to continue as it would be abuse of process of law.

Accordingly, the Criminal Petition is allowed quashing the proceedings against the petitioners in Crime No.133 of 2011 of Mandapeta Rural Police Station, East Godavari District.

Miscellaneous petitions, if any, pending in this petition shall stand closed.
