ORDER

This writ petition is filed to direct the 2nd respondent to consider the representation of petitioner dated 06.05.2017 for appointment as fair price shop dealer for Shop No.31, Sarkallu Village of Thavanampali Mandal, Chittoor District, on compassionate grounds, in terms of G.O.Ms.No.4 dated 28.02.2014.

During hearing, learned counsel for petitioner drawn the attention of this Court to the earlier order passed by this Court on 03.03.2015 in W.P.No.5156 of 2015, wherein this Court issued a direction to the respondent concerned to consider the application of petitioner for appointment, as fair price shop dealer on compassionate grounds for shop at Yapalapaya Thanda H/o.Rekulagadda Village, Chandampet Mandal, Nalgonda.

It is the contention of learned Government Pleader for Civil Supplies appearing for respondents that the petitioner is the daughter-inlaw of the deceased K. Munaswamy Reddy, who was the original fair price shop dealer, and not his legal heir.

At this stage, it is difficult to decide whether the petitioner is legal heir of deceased or not. However, leaving it open to the respondents to decide whether the petitioner is legal heir of the deceased fair price shop dealer in terms of G.O.Ms.No.4 dated 28.02.2014 and pass appropriate orders in accordance with law on or before 21.05.2016, after affording due opportunity to petitioner.

With the above direction, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
