THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.33282 of 2014 ORDER:

There is no representation on behalf of the petitioner. 2.

The prayer sought in the writ petition is as under:- "...to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus: i) To declaring the action of the respondents no.3 & 4 in call the petitioner to the Kakatiya University Police Station, Hanumakonda, Warangal District, without a crime and without a written notice as illegal arbitrary and violation of the petitioner fundamental rights; and ii) To consequently to direct the respondent no.3 & 4 not to call the petitioner to the Kakatiya University Police Station, Hanumakonda, Warangal District and not insist the petitioner to remit of amount of Rs.1,00,000/ in Crime No.458 of 2014 of Subedari Police Station, Hanumakonda, Warangal District; and iii) Pass such other order or orders as this Hon'ble Court may deem fit proper and appropriate in the circumstances of the case."

Learned Government Pleader appearing for the respondents 1 to 4 placed on record the written instructions issued by the Station House Officer, Kakatiya University Police Station, Warangal District. 4.

From a perusal of the said written instructions, it is revealed that one Utkam Deepak along with three others are accused in Crime No.458 of 2014, dated 08.10.2014, registered for the offences under Sections 364-A and 506-II IPC on the file of the Subedari Police Station. The said crime was transferred to Kakatiya University Police Station by the Superintendent of Police (Urban), Warangal, for investigation and further action. The above said crime was registered on the complaint of one Sri Dr.G.Surender Reddy. In the said complaint, it is stated that four unknown persons stopped his car and

PKR, J W.P.No.33282 of 2014 kidnapped him and called his wife demanding a sum of Rs.30,00,000/- as ransom. However, subsequently taking an amount of Rs.21,00,000/- from her, they released the complainant. During the course of investigation, the above said crime was traced out to Utkam Deepak and three others. During the confessional statement of Utkam Deepak, it has come out that he has paid an amount of Rs.1,55,000/- to the petitioner towards his debt payable to the petitioner. In view of the confession of Utkam Deepak (A.1) in Crime No.458 of 2014, the petitioner herein was called to the Police Station to verify the said statement and possible recovery of the said amount in the above mentioned crime.

It is also mentioned that there is no truth in the complaint of the petitioner that he was made to sit in the Police Station for hours and threatened him to remit an amount of Rs.1,00,000/- in Crime No.458 of 2014 or otherwise the petitioner and his family members would be implicated in false cases. It is also stated that the respondents 3 and 4 carried out their duty of investigation in Crime No.458 of 2014 strictly in accordance with law and they have never harassed, threatened or forced the petitioner to remit any amount in the above said crime, at any point of time. All the allegations made by the petitioner are invented only for the purpose of this case.

In view of the written instructions, it is evident that a part of ransom amount in Crime No.458 of 2014 appears to have been paid to the petitioner. The respondent police called the petitioner to the Police Station only for the purpose of verification of the statement

PKR, J W.P.No.33282 of 2014 given by accused No.1. Except calling the petitioner in connection with Crime No.458 of 2014, the respondents have not harassed, threatened or forced him to remit any amount in the above said crime. 6.

In that view of the matter, this Court is of the opinion that there are no merits in the writ petition and the same is liable to be dismissed.

Accordingly, the writ petition is dismissed. No order as to costs.
