HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.8220 of 2015 ORDER : (per Hon'ble Sri Justice R.Subhash Reddy) This writ petition is filed by the petitioner seeking Mandamus to declare the action of the 2nd respondent-Commercial Tax Officer, Gandhi Chowk, Tenali, Guntur District, in not responding to its letter dated 24.09.2014 requesting to issue 'C' Form for the period from October to December, 2007, as arbitrary and illegal.

2. The petitioner is engaged in the business of Synthetic yarn and is a registered dealer under the provisions of the A.P. VAT Act, 2005 and Central Sales Tax Act, 1956. During the period from October to December, 2007, it has purchased 32202.10 Kgs of Poly Fabrics, worth of Rs.23,25,636/- from M/s. Suresh Fabrics, Mumbai. It has addressed a letter dated 24.9.2014 to the 2nd respondent requesting to issue 'C' Forms for the period from October to December, 2007. The grievance of the petitioner is that though it is entitled for issuance of 'C' Forms for the said period, the 2nd respondent has not responded to its letter dated 24.9.2014 by issuing 'C' Forms for the said period.

3. The learned Special Standing Counsel for Commercial Taxes, on instructions, submits that as the application of the petitioner could not be traced for some time and it is now traced, if the petitioner approaches the 2nd respondent, the same will be considered.

In view of the said submission, we deem it appropriate to dispose of the writ petition directing the 2nd respondent-Commercial Tax Officer, Gandhi Chowk, Tenali, Guntur District, to consider the letter dated 24.09.2014 submitted by the petitioner requesting to issue 'C' Forms for the period from October to December, 2007 and take appropriate steps.

5. Subject to the above direction, this writ petition is disposed of, at the admission stage. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
