THE HON'BLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner is working as Deputy Tahsildar in the service of Government of Andhra Pradesh. He is assailing the order of dismissal from service issued vide G.O.Ms.No.180, Revenue (VIG.III) Department, dated 23.05.2015, on several grounds.

The Andhra Pradesh Administrative Tribunal is constituted as per the Administrative Tribunal's Act, 1985 to adjudicate all service matters concerning employees working in the service of Government of Andhra Pradesh. The Tribunal is vested with all the powers and jurisdiction to deal with service matters. As the Hon'ble Supreme Court in L.Chandra Kumar Vs. Union of India and others, held that the Administrative Tribunal is the Court of first instance concerning all service disputes, the petitioner has to invoke the jurisdiction of the Administrative Tribunal ventilating his grievance against the order of dismissal and cannot invoke the jurisdiction of this Court directly under Article 226 of the Constitution of India. Having regard to the same, the Writ Petition is dismissed giving liberty to the petitioner to avail the remedies as available under the Administrative Tribunal's Act, 1985. There shall be no order as to costs. Miscellaneous petitions, if any, pending this writ petition shall stand closed.
