HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL REVISION CASE No.836 of 2017 ORDER:

Impugning the order of the learned Collector (CS), Ranga Reddy District in 6-A proceedings of the Essential Commodities Act (for short 'the Act') in case No.A7/470(CS)/2015 ordering 100% confiscation of the seized stock worth Rs.7,394.50 Ps. on 01.12.2015, that was confirmed by the learned Principal District & Sessions Judge, Ranga Reddy District, in Crl.A.No.70 of 2015 dated 13.05.2016, the revision is filed.

Heard the learned counsel for the petitioner and the learned Public Prosecutor representing the State including respondent Nos.1 and 2 and perused the material on record including the impugned order.

So far as ordering of the confiscation for the clandestine there is nothing to interfere with the impugned order, however coming to the 100% of the seized stock confiscation of worth referred supra since the same is onerous, it is reduced to 50%. Accordingly and only to that extent, the criminal revision case is allowed in part before admission.

Consequently, miscellaneous petitions, if any shall stand closed. No costs.
