THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 22423 OF 2017 O R D E R:

This writ petition is filed questioning the inaction of the police authorities in not receiving and entertaining the complaint dated 26.04.2017 filed by the petitioners against the 5th respondent. When the matter is taken up for hearing, the learned Government Pleader for Home (A.P.) had placed on record the written instructions, which reads as follows: "It is submitted that there is a civil dispute between the petitioners and the 5th respondent, who is no other than the own brother of the petitioners, in respect of non-registration of land in favour of the petitioners by the 5th respondent. In this regard, the petitioners made a petition dt.26.04.2017l before the 4th respondent police station, which was duly examined, wherein it is disclosed that the dispute pertains to civil in nature and a non-cognizable one.

Accordingly, the 4th respondent herein advised the petitioners to seek redressal of their grievance before the competent civil court on 26.04.2017 in writing, which was also acknowledged by the 1st petitioner herein. Therefore, there is no inaction on the part of the respondent police authorities, as alleged in the writ petition. All other allegations of the petitioners against the respondent police authorities are false and baseless and the same hereby specifically denied."

Recording the above said instructions, the Writ Petition is closed. However, leaving it open to the petitioners to work out the remedies available, if any, in law. No costs. Consequently, the Miscellaneous Applications pending, if any, shall also stand closed.
