N.Chenchaiah v. The State Of Andhra Pradesh,
THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.30289 of 2016 ORDER :
Heard the counsel for petitioner, and the learned Government Pleader for Excise (Andhra Pradesh), for respondent nos.1 to 3. 2.
The petitioner has filed this Writ Petition objecting to the shifting of the 4th respondent's A4 licence shop from Utukur Village, Vidavalur Mandal to Mudhivarthi Village, Vidavalur Mandal. 3.
The petitioner is a social worker, and alleges that the villagers of Mudhivarthi Village are opposed to have a liquor shop in their village.
4.
There is no prohibition policy in vogue in the State, and the objections of the villagers that there should not be any liquor shop in the village, therefore, cannot be entertained. The petitioner also has not alleged that any other provision of the Act or the Andhra Pradesh Excise (Grant of Licence of Selling of Shop and Conditions of Licence) Rules, 2012 made thereunder had been violated. 5.
Therefore, I do not find any merit in the Writ Petition, and it is accordingly dismissed. No order as to costs. 6.
As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
