HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 3993 of 2016 Order:

This Writ Petition is filed for the following relief. "To pass orders particularly one in the nature of Writ of Mandamus declaring the impugned orders of the first respondent in Lr.Rc.No.A2/1398/2015, dated 16.01.2016 denying promotion while promoting the second respondent and his juniors and not awarding special promotion scale under automatic advancement scheme as arbitrary, illegal, discriminatory, violative of Article 14, 16, 21 of the Constitution of India and G.O.Ms.No.225, GAD (Ser.C), dated 18.05.1999 which is binding on the first respondent and in as much as the same was already implemented vide No.E1/15875/2013, dated 06.07.2013 and consequently direct the respondents to pay special promotion scale with effect from 2012 to the petitioner and consequential promotion as Principal on par with the second respondent with all the attendant benefits including seniority."

2. After filing this Writ Petition, when the second respondent herein namely D.S. Venkanna was promoted as Principal, vide proceedings dated 04.04.2016, denying the promotion of the petitioner, the petitioner filed WP No.17067 of 2016. During the pendency of the said Writ Petition, the petitioner is temporarily promoted as Principal subject to result of the Writ Petition.

3. In view of the same, no further orders need be passed in the present Writ Petition as the interest of the petitioner would be taken care of in WP No.17067 of 2016 which is pending in this Court.

4. The Writ Petition is, accordingly, closed. There shall be no order as to costs.

5. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed. ________________________ A.
