HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.45070 of 2016 ORDER:

This writ petition is filed seeking a direction to the 2nd respondent not to interfere with the civil disputes between the petitioner and the 3rd respondent in respect of land in Sy.Nos.5/14, 6/8, 6/26, 678/23, 67/24, 68/10 and 18/4, totally admeasuring Ac.6.03 cents, situated at Pavada Village, Jami Mandal, Vizianagaram District and not to arrest the petitioner in connection with F.I.R.No.148 of 2016 without due process of law. Heard and perused the material available on record. Though several allegations are made in the writ petition, now, the learned counsel for the petitioner submits that the petitioner is ready to cooperate with the investigation in F.I.R.No.148 of 2016 but, however, he is apprehending arrest and harassment in the hands of 2nd respondent-police.

It is also prayed to direct the 2nd respondent not to interfere with the civil disputes of the petitioner existing with the 3rd respondent. Learned Assistant Government Pleader for Home submitted that the 2nd respondent is not intending to interfere with the civil disputes between the petitioner and the unofficial respondent. Considering the circumstances of the case, without expressing any opinion on merits, the Writ Petition is disposed of directing the 2nd respondent not to interfere with the civil dispute between the petitioner and the unofficial respondent. Further the 2nd respondent is directed to complete the investigation in F.I.R.No.

charge sheet in accordance with law. The petitioner is directed to appear before the 2nd respondent-police as and when required during the course of investigation.
