THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18375 OF 2016 ORDER:

Heard the learned counsel for the petitioners and the learned Government Pleader for Municipal Administration and Urban Development, the learned Government Pleader for Revenue and Sri S.Lakshmi Narayana Reddy, the learned Standing Counsel for Greater Visakhapatnam Municipal Corporation. With consent of the counsel appearing for both sides, the present writ petition is disposed of at the admission stage. 2 . The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not considering the applications of the petitioners for regularisation of their Flat Nos.501, 404, 304, 401, 301, 402, 303, 403, 503 and 302 together with 45 square yards of undivided land covered by plot Nos.12 and 13, block No.1 in Sy.No.

131 situated in Chinagadila Village, Visakhapatnam Rural, Visakhapatnam, treating each Flat as one dwelling unit, as per G.O.Ms.No.128 MA & UD (M-I) Department, dated 22.05.2015 and G.O.Ms.No.296, Revenue (Assignment-I) Department, dated 12.08.2015 as illegal and arbitrary and consequently, to direct the respondents to issue orders of regularisation forthwith.

3. Though various grounds are raised in the writ petition, learned counsel for the petitioners restricts his prayer seeking a direction to the respondents to consider the representations made by the petitioners for regularization in terms of G.O.Ms.No.296, dated 12.08.2015 at the earliest.

4. Learned Standing Counsel for GVMC submits that the question of regularizing the constructions made would arise only if

the land is regularised. Learned Government Pleader for Revenue submits that if the representations made by the petitioners are still pending consideration, a direction may be given to the 2nd respondent to consider the same.

Having regard to the circumstances stated above and without going into the merits of the case, the Writ Petition is disposed of directing the 2nd respondent-District Collector, Visakhapatnam, to dispose of the representations made by the petitioners for regularisation of their Flat Nos.501, 404, 304, 401, 301, 402, 303, 403, 503 and 302 together with 45 square yards of undivided land covered by plot Nos.12 and 13, block No.1 in Sy.No.131 situated in Chinagadila Village, Visakhapatnam Rural, Visakhapatnam, treating each Flat as one dwelling unit, as per G.O.Ms.No.128 MA & UD (M-I) Department, dated 22.05.2015 and G.O.Ms.No.296, Revenue (Assignment-I) Department, dated 12.08.2015, in accordance with law, as early as possible preferably within a period of six (06) weeks from the date of receipt of a copy of this order.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
