THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.34016 OF 2016 ORDER:

This writ petition is filed seeking to issue a writ or order more particularly, one in the nature of writ of mandamus to declare the action of respondent No.4 at the instance of respondent No.5 in repeatedly insisting the petitioners to appear before his authority and further insisting to yield and settle to the terms of respondent No.5 by withdrawing the suit in O.S.No.129 of 2015 pending on the file of the Principal Junior Civil Judge, Markapur, Prakasam District filed by petitioner No.1 against respondent No.5 as illegal and arbitrary and consequently, direct the respondents not to interfere in any manner with petitioners' personal liberty and civil disputes.

Heard and perused the material available on record. 3.

Learned Assistant Government Pleader for Home denied the entire allegations and submitted before this Court that the petitioners were never called to the police station by respondent No.4 and respondent No.4 will not interfere in any of the civil disputes pending before the petitioners and respondent No.5. 4.

Considering the rival contentions of both parties, this Court is of the view that the writ petition can be disposed of with the following direction:

Respondent No.4 is hereby directed not to interfere in any of the civil disputes pending before the petitioners and respondent No.5. At the same time,

the present order will not stand in the way of respondent No.4 to proceed with the investigation if any complaint is registered against the petitioners for a cognizable offence.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
