THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 24728 OF 2010 O R D E R:
This Writ Petition was filed by the Corporator of 42nd Division in Warangal Municipal Corporation challenging the inaction of the respondents in commencing and completing the construction of Community Hall in Ward No. 42, Lashkar Singaram Village, as bad in law.
Respondent No. 1 filed a counter affidavit stating that the District Collector, Warangal, issued proceedings on 06-04-2010 with a request to the Commissioner of the Corporation to construct a Community Hall in S.C. Colony, Lashkar Singaram, Hanamkonda, Warangal, and an amount of Rs.5,00,000/- was allotted under M.P. Lads Scheme of Sri G.Giresh Kumar Sanghi, the then Member of Parliament (Rajya Sabha). However, in view of the objections raised by the locality people, the work was not taken up and the proposed site is an approved layout open space vide L.P.No. 33/79. If the proposed site is in an approved layout meant for open space, no construction activity shall be undertaken. Though an amount of Rs.5,00,000/- was sanctioned, the work was not taken up and the funds stood lapsed. In the circumstances, no relief can be granted to the petitioner in the present Writ Petition.
The Writ Petition is, accordingly, dismissed. Pending miscellaneous petitions, if any, in this Writ Petition shall stand dismissed in consequence. No order as to costs.
