Heard learned counsel for the petitioner and learned Standing counsel for Singareni Collieries Company Limited. 2.

According to petitioner he cannot discharge the functions of Coal cutter on account of his physical disability. He wanted medical examination about his capacity to discharge his functions. Alleging inaction in referring to the medical examination by the Corporate Medical Board, this writ petition is filed. 3.

According to learned Standing counsel, as per the request of the petitioner, petitioner was asked to appear before the Area Hospital for Medical screening test on 31.01.2017. But petitioner failed to appear. Therefore, the question of referring him to Corporate Medical Board does not arise.

According to learned counsel for the petitioner, representations dated 14.08.2017 and 02.02.2018 were submitted requesting for referring him to Corporate Medical Board. But so far they are not acted upon.

However, learned Standing counsel would submit that there is no proof of submission of said representations and in the absence of proof, it cannot be assumed that representation was infact made.

If petitioner has submitted the representations on 14.08.2017 and 02.02.2018 and the same are received, the General Manager, Ramagundem Area, Singareni Collieries Company Limited, is directed to examine the feasibility of referring

- 3 - the petitioner to Corporate Medical Board and furnish suitable reply within a period of four (4) weeks from the date of receipt of copy of this order.
