THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.12607 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/accused in Crime No.252 of 2023, on the file of Mirchowk Police Station, Hyderabad, registered for the offences punishable under Sections 307, 352 and 506 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

On 03.11.2023, the de-facto complainant filed a written complaint alleging that this petitioner and others were burning crackers. The de-facto complainant opposed, for which reason, it is alleged that this petitioner took out a knife and threatened to stab him. However, with the intervention of others, he escaped. The petitioner allegedly threatened the de-facto complainant that he would see his end.

Learned counsel appearing for the petitioner would submit that admittedly no injuries were received by the 2nd respondent and the petitioner is a student. Further, detention would hamper his future prospects.

Since the de-facto complainant had not received any injuries and keeping in view the conduct of this petitioner, he can be released on bail on stringent conditions:- i) The petitioner/accused shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties, for a like sum each to the satisfaction of VIII Additional Chief Metropolitan Magistrate at Hyderabad.

ii) The petitioner/accused after release shall appear before the concerned Station House Officer at 10:00 a.m. everyday for a period of ten days and thereafter, as and when required for the purpose of investigation.

iii) The petitioner/accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
