The Court made the following:

ORDER:

The petitioner, who is the Sarpanch of Ramapuram Gram Panchayat, Tuggali Mandal, Kurnool District, filed this Writ Petition, feeling aggrieved by the action of the respondents in not permitting construction of a building for Gram Panchayat. The petitioner pleaded that by proceedings, vide PTS/A6/2010, dated 23.6.2010, respondent No.2 has granted permission for construction of a building for Gram Panchayat in Survey No.92 of Ramapuram Village and that following the same, the Assistant Engineer and the Deputy Executive Engineer of Panchayat Raj Department also granted permission for the said construction. The petitioner has, however, pleaded that the Tahsildar on 29.12.2014, sent instructions to the Bill Collector to stop the construction work immediately and that on 30.12.2014, he has made a representation to respondent No.2 requesting him to permit construction.

The grievance of the petitioner is that despite pendency of the said representation for nearly one year, respondent No.2 has not taken any decision thereon.

After hearing learned Assistant Government Pleader for Panchayat Raj (Andhra Pradesh), this Court is of the opinion that interests of justice would be served, if respondent No.2 considers the grievance of the petitioner, as stated to have been ventilated in his representation, dated 30.12.2014, take a decision and communicate the same to the petitioner within one month from the date of receipt of a copy of this order.

Subject to the above directions, the Writ Petition is disposed of. As a sequel to disposal of the Writ Petition, W.P.M.P.No.48577 of 2015 shall stand disposed of as infructuous. ____________________________ JUSTICE C.V.NAGARJUNA REDDY 20th November, 2015 DR
