THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.23087 of 2016 O R D E R:

Heard counsel for the petitioner, Sri Y. Rama Rao, Standing Counsel for 5th respondent and Sri M.Rupender, Standing Counsel for 6th respondent.

2. The grievance of the petitioner in this Writ Petition is that he had been dispossessed by the respondents from his land in survey No.295/AA of Attapur Village, Rajenderanagar Mandal, Ranga Reddy District without initiating any proceedings under the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

3. Sri Y.Rama Rao, Standing Counsel for 5th respondent states that 6th respondent had laid a road in the petitioner's land.

4. Sri M.Rupender, Standing Counsel for 6th respondent states that the 5th respondent had laid a road in the petitioner's land.

5. Since it is not disputed that the land in which road has been laid is the private land of the petitioner, the respondents No.1, 2 and 5 are directed to initiate proceedings under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, pass an award under the said Act and pay appropriate compensation to the petitioner under the said Act, within a period of three (03) months from the date of receipt of a copy of this order. If the 5th respondent is of the view that the 6th respondent is responsible for laying the said road in the petitioner's land, then the 5th respondent is given

liberty to recover the amount of compensation paid to the petitioner from the 6th respondent.

6. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

7. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
