HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 25696 of 2016 ORDER:

1) Heard learned counsel for the petitioner and Government Pleader for Revenue. With the consent of both the parties, the writ petition is heard at the admission stage itself. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction of the respondents in considering the application for conducting survey of the land admeasuring Ac.5.00 in Sy.No.49/ 6, demarcating and fixing the boundaries of the plot No.12 to an extent of 1018 square yards situated at Gajularamaram Village, Qutbullapur Mandal, Ranga Reddy District, as illegal, arbitrary and violative of principles of natural justice. 3) Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking a direction for disposal of his representation dated 08.01.2016 made to the fourth respondent. The Government Pleader for Revenue submits that the fourth respondent has no authority to conduct survey and that the petitioner has to approach the authorized Municipal Surveyor or the Civil Court to get his grievance addressed.

4) In view of the above, this Court is of the opinion that no positive direction need to be issued. But however, the petitioner is directed to approach the authorized Municipal Surveyor and make an application for survey and demarcation of plot No.12 to an extent of 1018 square yards situated at Gajularamaram Village, Qutbullapur Mandal, Ranga Reddy District, in which event, the same shall be dealt with in accordance with law, if he is authorized to do so.

5) With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _________________________ JUSTICE C. PRAVEEN KUMAR 20.10.2016 gkv
