This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 7973 (for short 'Cr.P.C.) by the petitionerAccused No.13 to quash the proceedings against in CC.No.1403 of 2022 pending on the file of Principal Junior Civil Judge cum VIII Additional Metropolitan Magistrate, Kukatpally at Prashanthnagar. I I 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent - State. Perused the record.

The case of the defacto complainant/respondent No.2 is that this petitioner and 12 others called him to a hotel and snatched away original documents which were in possession of defacto complainant. The counsel for the petitioner submits that the petitioner was in China from 23.09.2015 to 05.11.2015, Whereas, the alleged incident took place on 28.10.2015. In proof of his travel, the copies of the passport are filed.

There shall be stay of all further proceedings in CC.No.1403 of 2019 pending on the file of Principal .lunior Civil Judge cum VIII Additional Metropolitan Magistrate, Kukatpally at Prashanthnagar against the petitioner/accused No.13 herein only. The Court shall go on with proceedings against the other accused. 5.
