THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35854 of 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the official respondents in interfering in civil disputes and insisting the petitioner to vacate the petitioner's site and handover to the sixth respondent and threatening the petitioner with dire consequences of implicating in false cases as illegal and arbitrary, and consequently to direct the official respondents not to interfere in the civil disputes between the petitioner and the unofficial respondent.

Heard and perused the material.

Learned counsel for the petitioner submits that the fifth respondent is interfering in the civil dispute between the petitioner and the sixth respondent, and he is threatening the petitioner with dire consequences if the petitioner does not vacate the petitioner's site and hand over the same to the sixth respondent, and as such, he prays this Court to direct the fifth respondent not to interfere in the civil disputes between the petitioner and the sixth respondent. Learned Assistant Government Pleader for Home (Andhra Pradesh) submits that the fifth respondent is not interfering in the civil disputes, more particularly, the civil dispute between the petitioner and the sixth respondent.

Considering the rival submissions made by both the counsel, the writ petition is disposed of with a direction to the fifth respondent not to interfere in the civil disputes between the petitioner and the sixth respondent and not to threaten the petitioner in whatsoever manner.

The fifth respondent is further directed to follow the due process of law laid down in Code of Criminal Procedure.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 24.10.2016 pln
