ORDER:

Petitioner sought for prayer to take up the pending Document No.P54/2014 dated 05.09.2014 for registration in respect of the properties in Sy.No.755/2A, 67/1 and 67/2 admeasuring Ac.3.08 cents of Nadikudi Village, Dachepalli Mandal, Guntur District and to release the same. The relief sought by the petitioner was granted by this Court by order dated 17.10.2014 in W.P.M.P.No.37211 of 2014 in W.P.No.29789 of 2014. Alleging non-compliance of the said order, this Contempt Case is filed.

2. In the counter affidavit filed on behalf of the 2nd respondent, the 2nd respondent avers that the document was returned to the petitioner with an endorsement on 09.09.2014 holding that it is an assigned land and the petitioner has not re-presented the petition consequent to the direction issued by this Court and so long as the document is with the petitioner and does not choose to present document, no action can be taken by the registering authority.

3. Learned counsel fairly submits that though petitioner has approached the SubRegistrar, but he does not have any evidence in support of the claim that document was re-presented, but Sub-Registrar refused to receive.

4. Having regard to the same, I cannot hold that the registering authority committed contempt of the orders by not complying with the direction issued by this Court. Therefore, the contempt case is closed. However, it is open to the petitioner to take steps to re-present the document as required to comply with the orders of this Court.
