The present writ petition is filed by the petitioners under Article 226 of the Constitution of India, seeking to declare the action of the respondents in seeking to dispossess the petitioners from the lands in Kunavaram Range, Sarivela Beet Adugurallapalli Section, Compartment No.106, without following the procedure as illegal, and further to declare the inaction of the respondents in considering the representations made by the petitioners on 20.7.2016 as illegal.

Heard and perused the material available on record. 3.
The learned Government Pleader for Social Welfare and the learned Government Pleader for Revenue submitted that they are not taking any coercive steps to evict the petitioners. The learned Government Pleader for Forests submitted that as per the written instructions of the Divisional Forest Officer, Chintur Division, the petitioners approached the Project Officer, ITDA, Chintur for grant of pattas by submitting a petition and the said petition was replied suitably stating that no planting work was taken up by the Forest Department in Compartment No.160 of Sarivela Beat of Kunavaram Range during 2015-2016 and no such coercive action was taken as alleged by the petitioners and that the petitioners are migrated tribes from the other states, who were damaging the valuable forest growth and they are occupying the forest lands under the pretext of podu cultivation with a view to get ROFR claims as per ROFR Act, 2006.

In view of the written instructions filed by the learned Government Pleader for Forests, this Court is of the view that there is no necessity to pass any orders in this writ petition.
