THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.27147 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction on the part of the respondents in providing electricity service connection to the shopping complex of the petitioner as illegal and arbitrary.

2. Heard Sri K.Ramakanth Reddy, learned counsel for the petitioner and Ms.Jagarlamudi Koteswari Devi, learned standing counsel for respondent Nos.1 and 2 - APSPDCL.

3. It is the case of the petitioner is that he had submitted application to provide electricity service connection in respect of shopping complex, an extent of Ac.0.97 cents located in survey No.173 of B.K.Palle Revenue Village, Madanapalle Municipality, Chittoor District. It is the further case of the petitioner that he paid the necessary fee on 08.4.2015 to the respondents as per the Rules and Regulations. Alleging that the staff of the respondents are causing delay in providing electricity connection, the petitioner made a representation dated 17.4.2015 to the second respondent.

4. At the time of arguments, the only relief sought by the learned counsel for the petitioner is to direct the second respondent to dispose of representation as early as possible. The learned standing counsel also consented for the same.

5. Having regard to the facts and circumstances of the case, the second respondent is hereby directed to consider the representation of the petitioner dated 17.4.2015 and pass appropriate orders in the light of the Electricity Act, 2003 and the relevant Rules made thereunder, as expeditiously as possible, preferably, within a period of one month from the date of receipt of a copy of this order.

6. With the above direction, the writ petition is disposed of.

Miscellaneous petitions, if any pending in this writ petition shall stand closed.
