THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.30389 of 2018 ORDER :

The relief sought for by the petitioner in this writ petition is as under:

"For the reasons stated in the affidavit accompanying, this Hon'ble Court may be pleased to issue an order, direction or writ more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent in not issuing posting orders in view of the letter dated: 28.06.2016 and 05.07.2016 as wholly illegal, arbitrary and unjust and consequently direct the Respondents to issue posting order by reinstating the petitioner into service and pass such further other order or orders as this Hon'ble Court deems fit and proper under the circumstances of the case." When the matter is taken up for consideration, learned Standing Counsel informed the Court that, by order dated 16.03.2017, the petitioner was removed from service. A copy of the order of removal is also served on the learned counsel for the petitioner. Since the petitioner is already removed from service, the prayer sought for in the writ petition cannot be granted.

Therefore, the writ petition is dismissed leaving it open to the petitioner, if he is so advised, to work out his remedies against the order of removal from service. Pending miscellaneous petitions, if any, shall stand closed.
