THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.7907 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the respondents 2 to 5 in not extending time by revoking the agreement dated 09.05.2012 having initiated action for extension as per memo dated 26.05.2015 and also memo dated 08.02.2016 issued by the second respondent and not releasing the amount for the work which was already executed by the petitioner as illegal and arbitrary. 2.
Heard the learned counsel for the petitioner and the learned Government Pleader for Panchayat Raj.

It is the case of the petitioner that the petitioner entered into an agreement with the third respondent on 09.05.2012 for laying of road. For one reason or other, the petitioner could not complete the work within the stipulated time.

The fourth respondent filed counter stating that the petitioner did not complete the execution of work as per the time schedule. 5.
The petitioner herein submitted a representation to the Superintending Engineer-3rd respondent on 21.02.2018. At the time of argument, the only relief sought by the learned counsel for the petitioner is to direct the third respondent to dispose of the representation of the petitioner dated 21.02.2018. 6.
In view of the submission made by both the counsel, this Court is not inclined to express any opinion touching the merits of the main case.

Having regard to the facts and circumstances of the case, the third respondent is hereby directed to dispose of the representation of the petitioner dated 21.02.2018 as expeditiously as possible, preferably, within a period of two months from the date of receipt of copy of this order.

With the above direction, writ petition is disposed of. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
