HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.19063 of 2017 ORDER:

Heard learned counsel for the petitioner and also the learned Government Pleader for Land Acquisition for respondents and perused the prayer in the writ petition with supporting affidavit and the material on record and particularly Section 3(g) sub clause (6) read with sub clause 5 & 7 of the National Highways Act, 1956 speaks the provisions of the Arbitration & Conciliation Act, 1996, shall apply to every arbitration under the Act and once there is an award passed, the arbitrator is the District Collector and any decision taken on the amount fixed from the dispute, if any, the application lies under Section 34 of the Arbitration Act before the District Court. Thus, it is for the petitioner to represent the return plaint if at all mistakenly returned by the lower Court as the issue covered by the expression of this Court in Nekkalapudi Ramakrishna Pratap Vs. District Collector1.

Accordingly and in the result, the Writ Petition is disposed of.

Consequently, miscellaneous petitions, if any, shall stand closed. No costs.
