THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.29344 of 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to declare the inaction on the part of the respondents herein not registering the case in spite of the complainant dt.04.07.2015 is highly illegal arbitrary and against the procedure of the code of criminal procedure and consequently to direct the 3rd respondent to register the case against accused basing on the compliant dt. 04.07.2015 large by the petitioner."
Heard Sri T.S.N. Sudhakar, learned counsel for the petitioner and learned Government Pleader for Home for respondents, apart from perusing the material available before this Court.
Today, when the matter is called, written instructions, dated 22-09-2015 furnished by the Asst. Sub-Inspector of Police, Sabbavaram Police Station, Visakhapatnam District have been placed on record by the learned Government Pleader for Home and the said instructions read as under:
"It is respectfully submitted that one S. Lakshmi the petitioner herein lodge complaint against one, Rapelli Satyam, Rapali Arjun, Rapali Kanakam and Devudamma stating that they are making in conveyance to the public road, when the petitioner asked the same they abused her with filthy language and threatened her. And also they remove shed which is meant for agricultural purpose at mid night and taken away instruments which are using for agriculture, hence requested to take necessary action.
Basing on the complaint a case was registered in Cr.No.147/2015 under Section 4365, 379, 509 and 506 r/w.34 IPC of Sabbavaram Police Station, and investigation is going on.
The respondent police will abide the directions if any passed by this Hon'ble Court."
On noticing the above said instructions, learned counsel for the petitioner has requested this Court to record the said instructions and dispose of the writ petition. In view of the above, the writ petition stands disposed of, by recording the written instructions, dated 22-09-2015 furnished by the Asst. Sub-Inspector of Police, Sabbavaram Police Station, Visakhapatnam District.
